In Washington, you can file a small claims action if the amount of damages you are requesting is less than $5,000. Unfortunately, you cannot file two small claims cases to keep the amount of damages under the small claims limit. Since the IOU is for $9,000, you can file a civil lawsuit against the individual seeking reimbursement for the full $9,000 in district court. Or, you can file one action in small claims court seeking $4,999.99. The benefit of small claims court is that it a low-cost and user-friendly alternative to filing a claim in district court. In addition, you do not need to hire an attorney to represent you in small claims court as you will need to if you file a civil lawsuit in district court.
