Question:

My lease ended 12/31/2016. When I moved in I gave first month ($1075) and 2 security deposits($2150). I had to give 60 days notice that I was not renewing. I had FedEx deliver the notice on 11/2/2016. From that moment the daily harassing phone calls began. To end this harassment I met with landlord and returned all keys and had her sign an acknowledgement for the return of the keys and that was terminating the lease from that day on 12/20/2016 along with my forwarding address. In Jan 2017 there were new people living in the condo. On 2/9/17 I sent via FedEx to be delivered on 2/10/17 a request to return my security deposits by 2/17/17. Landlord would not answer door or go pick up envelope from FedEx. On 2/17/17 landlord called me to come do a walk through and stating she would be sending my deposit and various mail that she had gone through that did not get forwarded. I told her I would not come do a walk through after people have been living there for a month and that should have been done before she had new people move in. Also explained that she had 30 days to return my deposits and it had been 60 days. She said she knew nothing about when my deposits had to be returned. As of today 3/18/2017 nothing has been received. Do I need to file a small claims case?

Yes, you need to file a suit.

Yes, you need to file a suit. The very best way to do that is through an attorney who knows the landlord tenant law in Florida. Look for one in that county.
