Question:

I want to adopt my husbands 16 yr old son. My stepson is the one who brought this up to me today that it was what he wanted. My husband and I had talked of it previously but really hadnt had the money to do so. My stepson has only seen his biological mother three times in his life. She had been an absent parent till he was twelve. when she got cancer is when she saw him those three times. I was wondering how difficult this would be if she didnt want this to happen. If it could make it more expensive so we have a good idea at what we are looking at.

Selected Answer:

Generally, if you wish to

Generally, if you wish to adopt, you must have the consent of both parents. Therefore, your stepson’s mother will have to approve of the adoption, and choose to terminate her parental rights. If she refuses to provide her consent, you may have the option of proving to the court that she is an unfit mother or has little contact with your stepson. This will likely be very difficult. For example, the court will examine the relationship between mother and son. To terminate a parent’s rights in this situation there has to be virtually no contact between mother and child and no attempts at contact as well. In addition, you will need to provide notice to the mother of the pending adoption case as well if you decide to pursue the adoption. Adoption is a very complicated process, and you should contact an experienced attorney in your state to assist you with this procedure.
