You can sue both an individual or a business in small claims court in New Jersey. However, New Jersey small claims handles cases that involve damages of $3,000 or less. Since your claim is for more than $3,000, you should file your claim in the regular special civil part in the superior court. The special civil part handles claims between $3,000 and less than $15,000. If you are more comfortable filing in small claims, you can file your claim in that court but you will waive your right to recover damages over $3,000.
